Client was acquitted by a jury of second degree murder after it was alleged that the client struck the victim in the head with a metal bar. The client was acquitted after advancing an argument of self defence and cross examining the Crown pathologist on the disputed cause of the head injury.

Client was acquitted of second degree murder, having been found guilty of the lesser included offence of manslaughter after the strangulation death of his mother. The defence vigorously challenged the opinion of the Crown’s expert pathologist and diminished the evidence of intent.

Six people were originally charged with Murder after a beating death with weapons. Two accused persons pled guilty to Manslaughter while the trial proceeded against the four remaining persons, also for Manslaughter. After successful cross examination of witnesses regarding the lack of participation of Mr. Foster’s client, he was the one person found Not Guilty.
